New Statutory Guidelines for E-Bike Battery Safety

The government has introduced new statutory guidelines for businesses involved in the production and distribution of lithium-ion batteries for e-bikes. This initiative aims to address the growing concern over fires caused by unsafe e-bikes and related products.
In 2023, at least ten fatalities in the UK were linked to fires involving e-bikes or e-scooters powered by lithium-ion batteries. Poorly designed or manufactured batteries pose a significant risk of thermal runaway, potentially leading to severe fires or explosions. The new guidelines require these batteries to include safety mechanisms to mitigate such risks.
Manufacturers and distributors must ensure their products comply with the General Product Safety Regulations 2005 (GPSR) in Great Britain, using the guidelines as a benchmark. The GPSR applies to all lithium-ion batteries for e-bikes, whether sold online or as part of conversion kits. Importantly, placing an unsafe lithium-ion battery on the market constitutes an offence.
Enforcement of these regulations falls under the remit of the Office for Product Safety and Standards (OPSS) and Local Authority Trading Standards. These bodies have powers to impose penalties, including criminal sanctions, for non-compliance.
The guidelines follow the October launch of the government’s Buy Safe Be Safe campaign, which educates consumers on purchasing safe e-bikes and e-scooters while avoiding unscrupulous online sellers. Retailers, manufacturers, online marketplaces, and consumer groups are collaborating to promote this initiative.
Earlier this year, OPSS removed unsafe batteries from the market, including two models of Unit Power Pack e-bike batteries made in China and linked to incidents in the UK.
This regulatory action underscores the government’s commitment to ensuring that the shift towards cleaner, active modes of transport, like e-bikes and e-scooters, is underpinned by consumer safety.
